The United Kingdom: Law and Economics in the Evaluation of Economic Instruments for Waste Management

Waste management in the UK has long made extensive use of economic instruments. They take three forms: landfill tax, packaging waste recovery notes and tradeable allowances for biodegradable municipal waste. Whether they are efficient and effective are important questions but so also is whether they are legitimate. This involves consideration of the legitimacy of the institutions that design and implement them; the processes by which the key design and implementation decisions are taken; and the legitimacy of the instruments themselves. The UK has addressed many of the legitimacy issues but important ones remain.
